End User Statement – Stock
Air Viper LLC requires the customer to confirm the end use of all Parts sold, leased, or loaned from Air Viper LLC to ensure compliance with (i) both U.S. Export Administration Regulations, the International Traffic in Arms Regulations, and other export control requirements of the U.S., the United Kingdom, or the European Union (collectively the “Export Regulations”) and (ii) any international sanctions imposed by the U.S.A., the EU, or the U.K from time to time (“Sanctions”). In respect of any aircraft or engine part which is the subject of a transaction with Air Viper LLC (Part), the Customer agrees not to: Dispose of any U.S. origin Parts classified by the U.S. Department of Commerce’s Bureau of Industry and Security as Dual Use items other than in the country of destination, as identified in any government license or authorization for the Part; Sell, lease, exchange or dispose of any Parts to any country, company, or individual that is either (i) required by any Export Regulations to hold a license to receive the goods (and does not hold the required license) or (ii) is prohibited from receiving exports by Export Regulations, as amended from time to time, including, but not limited to; Iran, Cuba, Syria, North Korea, Russia, and Crimea; Operate, or cause to be operated, any Part or aircraft between two points in Russia and otherwise fly or operate any aircraft or Part in Russia or in any other manner that would in any way constitute a breach of Sanctions; Export any Part to or for use in Russia in contravention of the Russia (Sanctions) (EU Exit) Regulations 2019, as amended by the Russia (Sanctions) (EU Exit) (Amendment) (No. 6) (the “Amendment”). Sell, lease, or export any Part to (i) any country, individual, or entity which is subject to any Sanctions or embargoes or (ii) any regions appearing on EAR, ITAR and OFAC, EU or UK Regulations Lists or notices unless otherwise authorized by the applicable government authority; Sell, transfer, export any Parts for use in activities which involve the development, production, use, or stockpiling of nuclear, chemical, or biological weapons or missiles, nor use Parts in any facilities which are engaged in activities related to such weapons; Sell, transfer, lease, exchange, export any Parts to any third party who does not commit to adhering to the Sanctions and Export Regulations as amended from time to time, in particular to third parties in EAEU countries (including Armenia, Kazakhstan, and Kyrgyzstan); and Export any Part to individuals or companies listed in the U.S. Commerce Department’s Denied Persons List, the U.S. Treasury Department’s list of Specially Designated National, or the U.S. Department of State’s list of individuals debarred from receiving Munitions Items list. We hereby confirm that we will utilize all Parts in compliance with the above statements. In addition, we confirm that we will not make any payments to Air Viper LLC from any bank accounts provided by banks which are subject to any Sanctions.
